1. Acceptance of Terms and Service Description

By accessing or using the GhibliAI platform at ghibliai.com, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site. We reserve the right to update these Terms at any time; continued use of the platform constitutes acceptance of any revisions.

GhibliAI provides an artificial intelligence image generation utility that transforms text prompts and uploaded photographs into painterly, anime-inspired artwork. The service is divided into distinct tiers:

• Free Tier: Unlimited standard-resolution generations, supported by display advertising. No account registration is required.
• Premium Tier: High-resolution, priority-queue generations without advertising interruptions, available via a one-time credit purchase.
• Digital Products: Prompt templates and creative resources available for purchase as downloadable digital goods.

2. Intellectual Property, Trademarks, and Content Ownership

GhibliAI operates as an independent technology platform. We are not affiliated with, endorsed by, sponsored by, or in any way officially connected to Studio Ghibli, Inc., Hayao Miyazaki, or any of their subsidiaries or affiliates. The term “Ghibli style” is used solely as a descriptive, nominative keyword indicating a specific artistic aesthetic — soft watercolor textures, naturalistic environments, and cel-shaded animation styles.

Users retain ownership of the original text prompts they submit and the resulting images generated, subject to the following:

• Users are solely responsible for ensuring their generated content does not infringe upon the copyrights, trademarks, or intellectual property rights of any third parties.
• Generating and commercializing images that directly copy protected characters or logos constitutes an infringement for which the user assumes total liability.
• Copyright law protects specific, tangible works of art, not generalized artistic styles; users must exercise due diligence when producing commercial assets.

All platform code, design elements, branding, and proprietary infrastructure remain the exclusive intellectual property of GhibliAI and its founders.

3. Prohibited Conduct and Platform Abuse

Users explicitly agree not to use GhibliAI to:

• Generate content that promotes violence, hate speech, illegal acts, terrorism, self-harm, or non-consensual explicit imagery.
• Generate, distribute, or use any imagery that depicts, exploits, or sexualizes minors in any form.
• Reverse-engineer, decompile, scrape, or systematically extract data from the platform through automated means.
• Attempt to bypass, manipulate, or circumvent the billing mechanisms or credit allocation systems.
• Generate content that impersonates individuals or organizations without their explicit consent.
• Upload images containing malicious code or content designed to interfere with platform functionality.

Prohibited conduct will result in immediate, permanent account termination without refund, and may be referred to appropriate law enforcement where legally required.

4. Billing, Refunds, and Limitation of Liability

All Premium Tier purchases are processed by our third-party payment processor. Due to the computationally intensive nature of AI generation and the immediate digital delivery of premium credits, all sales are final. We do not offer refunds once credits have been allocated to an account.

If you experience a technical failure during generation that consumed credits without producing an output, please contact [email protected] within 7 days of the incident for a case-by-case review.

The AI-generated outputs are provided strictly “as is” without warranties of any kind. GhibliAI, its founders, employees, and affiliates shall not be held liable for any direct, indirect, incidental, or consequential damages arising from the user’s application of the generated imagery. In no event shall GhibliAI’s total cumulative liability to any user exceed the amount paid by that user in the preceding 12 months.

5. Advertising and Free Tier

The Free Tier of GhibliAI is supported by display advertising revenue. By using the Free Tier, you consent to the display of contextually relevant advertisements. GhibliAI does not control the specific advertisements shown and is not responsible for the content or practices of third-party advertisers.

6. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Disputes arising from these Terms or your use of GhibliAI shall first be attempted through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association.
